Efforts to publicize this lawsuit against Monsanto for false advertising with Roundup, filed in Los Angeles County Court on April 20, 2015, have been rejected by the LA Times, Huffington Post, CNN, and Reuters, one of the world’s largest news agencies. The plaintiff’s attorney, T. Matthew Phillips, has been posting the suit in Wikipedia’s Monsanto litigation section, but it keeps getting removed.
T. Matthew Phillips is the first private attorney to file a lawsuit against Monsanto for false advertising. The current three plaintiffs are all Los Angeles residents and so far the class action suit’s plaintiff position is restricted to “California residents who have purchased Roundup at anytime during the last four years”.

However, class action suits that succeed or gain momentum in one area are repeated against the same defendant in other areas. Monsanto’s Roundup is the best selling herbicide weed killer in the world. It’s the reason why GMOs are created, allowing those plants to resist Roundup.

Now’s the time to attack on several fronts. The WHO’s announcement that Roundup is “probably carcinogenic to humans” has been publicized and revelations have surfaced that the EPA and Monsanto knew of Roundup’s carcinogenic toxicity for decades.

According to Nancy Swanson of Seattle GMO Examiner, even the American Cancer Society has agreed with the conclusion from the international group of scientists within the World Health Organization (WHO).

Swanson also reported that just before this lawsuit filed by Phillips in Los Angeles, Beijing resident Yang Xiao-lu filed a lawsuit against the Chinese Ministry of Agriculture requesting full disclosure of the toxicology report submitted to the Chinese government for glyphosate pesticide registration in China, and this demand was not rejected as others were.

It seems obvious that attacking Roundup in every way possible NOW is the best way to fight back against the chemical company Monsanto’s attempt to control the food supply and poison us.

Any success with these legal attacks against Roundup would expose the truth about Monsanto’s centerpiece product Roundup. And that data will add more clout to GMO labeling attempts.

SOME DETAILS FROM THE SUIT

Keep in mind that a civil suit requires only a preponderance of evidence instead of evidence that proves without a doubt. This civil suit demands a jury hearing. Proving false advertising in a California court is the easiest first blow, according to Phillips. If you look over the suit from here, you’ll see that it is very clear, straight forward, and provable. Don’t worry, Phillips has the science and the scientists.

If it does go to a jury trial, the facts disclosed within that procedure become part of the public domain. If Monsanto settles out of trial, then no media light will be shed on the dirty details of Monsanto’s false advertising. But Phillips is determined to go to trial and not be bought off.

Here’s the crux of this suit, which contains minimal legalese and you can access here. It’s what Roundup has this statement predominately placed on it’s product label, which is displayed at the top of this article: “Did You Know? Glyphosate targets an enzyme found in plants but not in people or pets.”

That enzyme is EPSP glyphosate synthase, and it’s also found in human gut microbia.

Also, the Roundup label falsely implies only one enzyme is endangered. But glyphosate and its added ingredients to make it absorbed through plant tissue more effectively have been discovered by researchers to create a biocide that permeates and kills everything in its path, even blocking the designated GMO Roundup protected plant, soy, corn, and others’ nutritional uptake from soil.

You can’t remove Roundup’s herbicidal residue. It’s effectiveness comes from Roundup’s ability to penetrate into plant cellular tissue. So you can eat it. More toxin and less nutrition. If you’re around where it’s being sprayed, you can breathe it in.

Remember, if this suit has any success, other attorneys, legal firms, and Attorneys General in different states will pick up the same ball and pitch it at Monsanto’s number one selling product – Roundup. Almost all GMO crops are designed to sell Roundup. This could be Monsanto’s Achilles heel.
