ON December 13, Michael Mansfield QC will lead a case at the Royal Courts of Justice in London against the Government concerning the negative health effects of 5G and other non-ionising (or radio-frequency) radiation. Permission to present this case was granted at the Court of Appeal earlier this year because of Government ‘failure to give adequate information to the public about the risks of 5G and to explain the absence of a process for investigation of any adverse health effects’.

The committee which is tasked to ensure that our health is protected from radio-frequency radiation (RFR), also known as electromagnetic fields (EMFs), is the Committee on Medical Aspects of Radiation in the Environment (COMARE).

I was staggered when they told me two years ago: ‘COMARE has not previously reported on possible health effects from EMFs and at present there are no requests from government departments for the committee to provide advice on this issue.’ Furthermore, their July 2019 minutes reveal that ‘COMARE has not been asked to look at 5G concerns and therefore does not have a 5G strategy’.

In a statement, dated November 23, 2022, the French General Directorate for Competition, Consumer Affairs and Fraud Prevention (DGCCRF) revealed major breaches by distributors of mobile phones and connected devices (the list has not been made public).

Indeed, these companies are required to display on their products, since July 2020, information about the Specific Absorption Rate (SAR) values. This being mandatory on every device emitting electromagnetic waves – not just cell phones, as was the case before.

61% of checked SAR displays, considered as abnormal

However, checks carried out in 2021 by the DGCCRF revealed the absence of display in many cases. Worse, investigators discovered non-compliant displays, some showing a value of zero, which is technically unfeasible.

Thus, 270 institutions out of the 470 visited were considered abnormal, like 61% of the devices checked. The investigation ultimately resulted in 212 warnings, 53 summonses and 8 fines.

These are now 37 different models of cell phones, identified as dangerous for the health of users, that have been either withdrawn from the French market or have had their Specific Absorption Rate (SAR) updated by software. Latest ones: the Samsung Galaxy Z Flip and the Wiko Y82.

Samsung has been given a 7,500 euros penalty

In its press release published on the 18th of November, the French National Agency of Frequencies (ANFR) revealed that it detected too important SAR values on two other cell phones. First of them, the Galaxy Z Flip from Samsung, has initially been measured with a trunk SAR of 2.05 W/kg, the regulatory level being fixed at 2 W/kg. It even raised to 3.024 W/kg after the first software update made by the company. A second one has thus been necessary to make the cell phone compliant, the trunk SAR being brought back to 1.04 W/kg. By the way, Samsung has been penalized with a 7,500 euros fine.

On January 13, 2020, Turin’s Court of Appeals confirmed a 2017 decision determining that a former Telecom Italia worker’s acoustic neuroma (a benign tumor in the ear) was caused by his mobile phone use. This is the sixth time that an Italian court has affirmed a causal link between cell phone use and brain tumors, including decisions by the High Court of Italy.

The Appellate court reached its decision after a review of the evidence and after receiving the opinion of two court-appointed experts. The experts referred the court to studies indicating that individuals who speak on their phones for an average of 30 minutes a day for at least 10 years increase their risk of developing head tumors. After considering this evidence, the Appellate court in Turin stated, “There are solid elements to affirm a causal role between the exposure of the person to radiofrequencies from mobile phones and the disease that arose.”

Dr. James C.
