They refer to a ruling by the Bernese administrative court from August 2023, according to which a planning application is required to increase the transmission power of an adaptive antenna. The specific case concerned an antenna in Büren an der Aare. According to a communiqué from the mobile radio critics, the ruling is now legally binding. It has far-reaching consequences.

In the canton of Berne alone, a total of 386 antennas are therefore in illegal operation. A mobile phone critic has requested the list of all sites from the canton, citing the principle of publicity. It was enclosed with the media documents on Tuesday. According to the list, 75 antennas are affected in the city of Bern alone.

Radiation is said to be three times higher

The form letter to the 127 municipalities states: "As you can see from the list, adaptive antennas were also illegally installed in your municipality without a planning application and publication with the correction factor." An increase in transmission power had therefore been carried out.

We request that you, as the responsible building police authority, ensure that the legal situation is restored in your municipality (...)." Otherwise, the company reserves the right to press criminal charges for abuse of authority and favoring the mobile industry.

Citing information provided by the canton, the mobile phone critics write that antennas with increased transmission power can cause up to three times higher radiation exposure, both in terms of time and location. Where and how much radiation exposure occurs must be examined in a building permit procedure.
