Multiple families are suing most of the major wireless companies and their trade association, asking for hundreds of millions in damages, claiming cellphone use causes brain tumors.

Monique Solomon Martinazzi, a plaintiff whose husband Andy passed away at age 43, said he had a brain tumor which developed right where he used to hold his cellphone.

In a judgment rendered on September 22, 2022, the seven plaintiffs, Tracey Ariel, Claire O’Brien, Erika Patton, Zoe Patton, Alex Tasciyan, Mathew Nucciarone and Vito Decicco, have been given a win by Judge Christian Immer. They will therefore be allowed to launch a class action against the manufacturers of Apple and Samsung smartphones, in the context of the Phonegate scandal.


The action had been initiated in September 2019 by Attorney Charles O Brien, following the revelations in August 2019 of American journalist (and 2008 Pulitzer Prize winner) Sam Roe in the Chicago Tribune.

In an interview with The Defender, Hunter Lundy, an attorney representing plaintiffs in two lawsuits alleging cellphones caused plaintiffs to develop brain cancer, said he was frustrated with the legal system’s slow pace, but that he believes the “truth is going to come out.”


A judge this month is hearing evidence in a lawsuit filed in 2011 by a group of individuals who developed cancer, allegedly as a result of radiation from their cellphones. Depending on how the judge rules, the lawsuit could finally head to a jury trial.

Evidentiary hearings in Murray v. Motorola began Sept. 12 in the Superior Court of the District of Columbia, and are scheduled to continue until Sept. 30. Expert testimony will be presented during the hearings before the case goes before a jury.

In a parallel case that may have repercussions for the D.C. case, a similar lawsuit before a federal court in Louisiana — filed by the widow of a man who died of an aggressive form of brain cancer allegedly caused by cellphone radiation — also is headed to trial.

Abstract

The fifth generation of radiofrequency communication, 5G, is currently being rolled out worldwide. Since September 2017, the EU 5G Appeal has been sent six times to the EU, requesting a moratorium on the rollout of 5G. This article reviews the 5G Appeal and the EU’s subsequent replies, including the extensive cover letter sent to the EU in September 2021, requesting stricter guidelines for exposures to radiofrequency radiation (RFR). The Appeal notes the EU’s internal conflict between its approach to a wireless technology-led future, and the need to protect the health and safety of its citizens.

In a ruling issued on August 26, 2022, the judges of the 9th Circuit affirmed that Federal Communications Commission (FCC) regulations prevail in the lawsuit against Apple over the radiation of its iPhones.

The District Court dismissed the class action lawsuit claiming that Apple’s iPhones expose their users to radiation exceeding regulatory levels in actual use (for example, as carried in a pocket).

“Plaintiffs want a California jury to determine that phones that the FCC said are safe, are dangerous, and find that disclosures that the FCC said are sufficient are inadequate,” Joseph R. Palmore, who represents Apple, told the panel. “And they would invite juries in all 50 states to make their own determinations on these same questions.”

Having internet access while en route on flights isn't as dangerous when it's WIRED, as it is in Boeing's Dreamliner. It's the WIRELESS technology that's dangerous. Yet it's now being beamed through the cabin on most airlines. Whether it's being used by passengers depends on, in part, whether it costs extra or is free.

Lloyd's of London, the bellwether of the insurance industry, declared in 2015 that the science shows conclusively that wireless technology causes non-ionizing radiation. Lloyd's announced that they are not covering health claims due to wireless devices in ordinary policies, and the entire insurance industry has followed.

Switzerland: Popular Initiative Launched by Cross-Party Committe to Better Protect the Population against Electrosmog

The collection of signatures for the "SaferPhone" initiative, which aims to incorporate health protection against non-ionizing radiation (NIR) into the Federal Constitution, will begin on September 13, 2022. Since the allocation of 5G licenses to the three operators in Switzerland in February 2019, the deployment of this technology has encountered strong resistance from the population. Many new independent associations have been created to counter its development and have launched thousands of opposition procedures against new antennas and modifications to existing ones.

A representative survey of the comparison portal, Comparis, carried out in May 2022, showed that 41.7% of the population are opposed to the implementation of 5G. Another survey worth mentioning is from the ETH (Swiss Federal Institute of Technology in Zürich) where 60% of the population believe they are NOT adequately protected from EMF signals.

Law360 (August 26, 2022, 9:33 PM EDT) -- The Ninth Circuit backed a district court's decision to toss a proposed class action claiming that Apple iPhones expose users to dangerous radiation, saying Friday that federal regulations setting radiation levels preempted the state law used to bring the case against the tech giant.

The Communications Act of 1934 and the Telecommunications Act of 1996 granted to the Federal Communications Commission broad regulatory powers over wireless communications devices, the panel said.

"We hold ... that the FCC's regulations of the [radiofrequency] radiation of cell phones, promulgated under the 1934 Act, preempt plaintiffs' state-law claims as they are presented to us on appeal," says the judgment written by U.S. Circuit Judge William A. Fletcher.

The U.S. Court of Appeals for the Ninth Circuit on Friday affirmed the dismissal of a lawsuit alleging Apple iPhones emit dangerous radiation after the plaintiffs themselves conceded the opposite was true on appeal of a trial court’s summary judgment for the tech giant.

The lawsuit followed an August 2019 report in the Chicago Tribune that said its investigation into RF radiation exposure in cellphones revealed from the iPhone 7 “measured over the legal safety limit and more than double” what Apple found from its own testing.

‘The Upper Tribunal has ruled that a council must secure special educational provision for a child who has electromagnetic hypersensitivity and is particularly sensitive to Wi-Fi signals.

In EAM v East Sussex County Council (Special educational needs) [2022] UKUT 193 (AAC), on appeal from the First-tier Tribunal, Upper Tribunal judge Jacobs found that the child should be considered disabled by her condition under the Equality Act 2010 and that she required an Education, Health and Care Plan (EHCP).

The child’s parents – who argue that their daughter needs to be schooled in a ‘low electromagnetic environment’ – have been attempting to secure an EHCP that acknowledges her condition since 2017.

A Sydney high school has seen a dramatic decrease in behavioural issues and a boost in physical activity and students talking to each other just two months after it tightened restrictions on mobile phone usage.

Davidson High School principal David Rule said there had been significant changes since students in years 7 to 10 were banned from using mobile phones at school.

“Classrooms have effectively become phone-free and this has allowed staff to focus on educating students,” he said in a school newsletter. “Finally, in eight weeks of the policy, there has been a 90 per cent reduction in behavioural issues related to phones in the school.”

My [Dr. Joel Moscowitz] notes: Although the title of the following report from the WHO International Agency for Research on Cancer is in German, the report is available in English.

The report's summary, "no indications of a detectable effect of mobile phones have been found," seems misleading because it is inconsistent with the report's final conclusion, namely, "An increased risk in the 10% heaviest mobile phone users was an exception to this general situation, as it remained plausible."

The report's bottom line:

"This ecological data is not sufficient to dismiss every potential mobile phone related risk scenario, but suggests that the risk – if it exists - would be very small, only occur after very long latency periods of several decades, or only affect small subgroups within glioma patients."

The progressive boarding and college preparatory Buxton School has notified faculty and students that, as of the start of the fall 2022 semester, smartphones will not be allowed on campus. At all. Since most of the students live on campus, that is effectively a 24-hour, seven-day-a-week ban on the devices. Smartphones will be banned entirely from the school and not just for the kids — for the adults, too. People will still be able to use “dumb” phones and connect to the Internet on laptops or tablets.

Recently, we tried to cut through the babble about 5G, look at actual data, and figure out how troublesome it really is for aviation. (See Pro Pilot, April 2022, p 8). Since then, the Federal Communications Commission (FCC) has doubled down on blaming its victims, ordering avionics makers to bring their “defective” radar altimeters up to a standard of signal discrimination required in no other country. However, that is not our topic here. This time, we will look at what electromagnetic fields (EMFs) may be doing – not to your equipment, but to you.

Why EMFs matters

Many hundreds of scientific studies have linked radio frequency EMFs to serious medical issues.

They include DNA damage, rare brain cancers, including glioma and acoustic neuroma, salivary tumors, heart disease, diabetes, sperm abnormalities, reduced volumes of the brain’s gray matter and damage to white matter, neuropsychiatric disorders such as anxiety and depression, and even very early onset Alzheimer’s disease.

The World Health Organization WHO recommends the mentioned guideline, which has been adopted by  a large part of the world's countries and has become part of the wireless regulatory framework. Although the US uses IEEE/ICES and FCC standards, it also seeks to "harmonize" with Icnirp.

Icnirp's safety instructions are based on one basic principle, according to which the only proven health effect caused by radiation exposure is the thermal effect. It appears when the temperature of the skin tissue rises above 1 degree Celsius, and when the temperature rise falls below one degree Celsius, the radiation is considered harmless to health. Icnirp's view is that the radiation level of wireless devices according to its safety guidelines is not sufficient to produce a temperature rise in skin tissue. Furthermore, according to Icnirp's science review, without that temperature rise there can be no proven effects. Icnirp has drawn up its safety instructions to protect consumers only from possible thermal effects, which the commission considers sufficient.

A building on Drahtzugstrasse in Basel

My wife and I spent a few days in Basel, Switzerland, earlier this month. We came for its many exceptional museums, and they didn’t disappoint. One afternoon as we were walking through town, not far from the complex that is home to Art Basel, the annual contemporary art fair, I spotted a carefully crafted warning on the side of an otherwise unremarkable building on Drahtzugstrasse. “The Odious Smell of Truth,” it called out.

With a little Googling, I learned that the expression comes from the title of an exhibition held at the Royal College of Art in London in the spring of 2017. The show was organized by Peter Kennard, a noted British political artist, and his students. They called themselves the Rage Collective. What does it mean, they wanted to know, to tell the truth in a world of false news and social media misinformation.

As it happens, a few days later while I was making my way home to New York, I received an email from Peter Hensinger, the scientific director of Diagnose Funk, a German-Swiss environmental and consumer protection group. It took me right back to those words above Drahtzugstrasse.

On July 11, 2022, the French National Frequencies Agency (ANFR) revealed in a press release that three new models from manufacturers Samsung (Galaxy Note 10 Plus), Hisense (Infinity H 30) and Gigaset (GX290) have been checked for SAR exceedances. A software update has been imposed to the manufacturers in order to bring the SAR back to the regulatory level (procedure for which Phonegate Alert is reserved).

WASHINGTON DC: The Journal of the National Cancer Institute has published a letter from distinguished experts disputing the Oxford “million women” study claiming no link between cell phone use and brain cancer. The new letter lays out why the Oxford report was deeply flawed. The authors note that substantial credible research links cell phone radiofrequency radiation to cancer and the experts recommend reducing exposures in alignment with numerous governments.

The Journal of the National Cancer Institute letter concludes:

“The majority of animal and cell studies have found nonionizing RFR can induce oxidative stress- a key characteristic of human carcinogens and a way that RFR can initiate or promote tumor development as well as play a role in the development of other diseases.

In March 2022 after two years of waiting, the Canadian agency, Innovation, Science and Economic Development (ISED) sent to our contact, Sharon Noble, the list of test results of 90 smartphones whose SAR (Specific Absorption Rate) had been monitored between 2015 and 2021.


The SAR is an indicator supposed to protect the health of users. However, the Canadian agency had omitted to specify the SAR measurement distance between the cell phone and the body. We now understand why: according to new data (requested from the ISED, received in a letter on June 8, 2022), 9 cell phones out of 10 would far exceed the regulatory thresholds during real use of the phone in contact with the body.

Since then, the list of victims has come to include four White House staffers and officials at the U.S. Embassy in Vienna. Together with their two young children, the couple moved into a breathtaking apartment on the 11th floor of the World Financial Center looking out on the iconic, golden façade of the Shanghai Exhibition Center, a temple – complete with fountains and colonnades – that was built to celebrate the friendship between Russia and China. In hindsight, Garfield says, though, the red star at the very top of the tower should have seemed like a bad omen.

Indications have been found that leukaemia is more prevalent among adults who live near such power lines. One possible explanation for this could be the exposure to the magnetic fields generated by the power lines. In the workplace, where exposure to magnetic fields can be higher than in residential areas, studies have also indicated that exposure may increase the risk of leukaemia, but also a number of other types of cancer and neurological diseases.

A constellation of unexplained neurological symptoms commonly known as "Havana Syndrome" has plagued U.S. diplomats stationed abroad since 2016. But U.S. officials are not the only ones who have reported trouble with speech, balance, and eyesight; some of their children have as well.

60 Minutes has found more than 20 children whose parents say they have been affected by unexplained neurological ailments after incidents that occurred while their parents were serving abroad. In one case confirmed by 60 Minutes, a mother and her infant were affected while the baby was breastfeeding. Both have been diagnosed with a traumatic brain injury.

Wireless devices like cell phones, Wi-Fi and other communication technologies release radiofrequency radiation that can harm the human body.

In both human and animal studies, exposure to radiofrequency radiation emitted from wireless devices is absorbed by the body and can harm the reproductive system. (See table below.) The effects show up in studies at a wide range of frequencies – 800 megahertz to 2.45 gigahertz – in both male and female reproductive systems. How much harm the exposure causes depends on the frequency of exposure. The extent of harm is also influenced by the length of exposure, though a recent meta-analysis shows it’s not clear how much of a role that factor plays.1

A new peer-reviewed paper published in the journal, Reviews of Environmental Health, found that the International Commission for Non-Ionizing Radiation Protection (ICNIRP) bases its recommended exposure limits for wireless (i.e., radio frequency [RF]) radiation primarily on research produced by its own members, their former students and close colleagues.

Since the middle of 2019, the UK’s mobile operators have been racing to deploy 5G technology around the country, broadly proclaiming that the technology would revolutionise the consumer experience in a short few years.

But while the new technology has the potential to unlock many exciting new use cases, from virtual reality to industrial automation, particularly as 5G standalone networks begin to be rolled out in recent months, the reality for most consumers is that a 5G connection currently offers them little more than a minor speed boost.

Perhaps this is why, at least in part, that a new study from YouGov, conducted via Global Profiles, shows Brits to be broadly disillusioned with the relatively new technology.

On 27 June 2022, just a few days after a presentation on wireless radiation exposure by Children's Health Defense, featuring Attorney W. Scott McCollough and Dr. Natalie Stadler, the group aired an excellent discussion on reducing the risk of wireless radiation exposure. The presentation was made by Cecelia Doucette, Director of Massachusetts for Safe Technology, a public interest group that educates citizens, public servants, lawmakers and health care professionals on the risks of wireless radiation exposures to children, adults and the environment. Cecelia Doucette showed many practical ways of protecting oneself from exposure to wireless radiation.

On May 14th, our five associations – Robin des toits, Phonegate Alert, European Cancer and Environment Research Institute (“ECERI”), Center for Independent Research and Information on Non-Ionizing Electromagnetic Radiation (“CRIIREM”) and Environmental Health Trust (“EHT”), had sent an informal appeal to the French Agency for Food, Environmental and Occupational Health & Safety (ANSES) contesting:

  • on the one hand, the non-publication and the non-inclusion by ANSES of the comments and contributions made by each of our associations in the framework of the public consultation on the expert report and the associated opinion published on April 20, 2021, on “Population exposure to electromagnetic fields associated with the deployment of “5G” communication technology and the related health effects”, by requesting their reintegration;
  • on the other hand, the above-mentioned report and consolidated opinion in order to integrate the comments and contributions made.

Scott McCollough, part of the legal team who challenged the FCC regulations in 2019, Dr. Natalie Sadler, psychiatrist, and doctors and presenters of the CHD team.

Scott McCollough began by explaining what are electromagnetic fields (EMF), radiofrequency radiation (RFR), modulation, pulsation. Electromagnetic energy evokes a biological response in all living things. Dr. Sadler mentioned the particular sensitivity and extreme vulnerability of children to exposure to EM radiation.

Mr. McCollough went on to explain 5G, emphasizing that we need to be concerned about all types of EM radiation. 5G is more useful to large industries than to consumers. "All these so-called consumer applications are merely the excuse that is being used to convince people that they should accept the exploding number of transmitters close to their home." But 5G is also the means of implementation for digital passports, credit scores... It is built for surveillance and control.

(CNN) Mobile phone carriers have agreed to another delay in rolling out some 5G service to prevent interference with airplane technology, the Federal Aviation Administration said Friday.

The FAA said the delay, for an additional year, will allow more time for the permanent fix: replacing or filtering the devices that measure an aircraft's distance from the ground, called radar altimeters. The new technology's promises include faster speeds, but aviation officials say the radio waves can be picked up in some cases by the radar altimeter.

The new timeline prompted concerns from major airlines and operators of regional jets, the latter of which would be subject to an even more aggressive end-of-2022 deadline. The Regional Airline Association said the FAA is "pressuring airlines to meet implausible deadlines."

Bern, 15.06.2022 - The first monitoring report on non-ionizing radiation (NIR) in Switzerland is now available. The results indicate that the population's exposure to radiation is moderate overall. The Federal Office for the Environment (FOEN) had been mandated by the Federal Council in 2019 to set up NIR monitoring in Switzerland.

Fixed and cell phone antennas, radio transmitters, wireless computer networks (WLAN) and other radio applications, but also power lines, contact lines and household appliances generate non-ionizing radiation. For the first time in 2021, measurements were carried out throughout Switzerland to determine the level of exposure of the population. The FOEN commissioned the project consortium SwissNIS to carry out the measurements (see Box 1).
